1. The service

AtmosCard ("AtmosCard", "we", "us") provides a web dashboard for funding prepaid Visa and Mastercard debit cards with cryptocurrency. Card issuing, payment processing and custody of pooled funds are performed by licensed third-party partners under the Visa and Mastercard payment networks. AtmosCard provides the interface, the balance ledger and support; we are not a bank, not the card network, and not a money transmitter. Cards are real network-branded debit cards with US billing addresses, usable online, in stores and with Apple Pay / Google Pay wherever the networks are accepted.

2. Eligibility and acceptance

You must be at least 18 years old and able to enter a binding contract under California law to use AtmosCard. By creating an account — which records your acceptance of these Terms and the Privacy Policy with a timestamp — you agree to them. If you do not agree, do not create an account or use the service.

3. Your access code is your account

Your account is controlled by an access code generated at signup and shown once. Whoever holds the code controls the balance and the cards. Treat it like a seed phrase: store it offline and never share it. AtmosCard support can never see, reset or recover your code by hand.

Recovery: if you attached and confirmed a recovery email, you can recover a lost code through a confirmation link sent to that email. A recovery request changes nothing until you click the link and choose to reset; the link is single-use and expires after 30 minutes. We are not liable for losses caused by a lost or stolen access code where no confirmed recovery email was attached.

4. Fees

• Card issuance: $19.99, charged once per card at the moment of issue.
• Deposits (top-up fee): 3.5% of the deposited amount plus a flat $1.00 network fee per deposit.
• Card loads (funding conversion): the crypto-to-USD conversion cost (about 1.75% plus processor markup) plus a service fee of 2% of the amount loaded (minimum $2.00) per load.
• Minimums: $25 per deposit, $20 per card load.
• No monthly fees, no inactivity fees, no charge for declined payments.

Every charge is quoted all-in before you confirm it, and by confirming you accept that quote. Blockchain network fees are borne by the sending network and are not set by AtmosCard.

5. Custody and risk

Deposits pool in custodial accounts operated by our processing partners. Your balance is a claim on that pool, tracked in our ledger and visible in your dashboard at all times. AtmosCard balances are not bank deposits and are not covered by FDIC or any deposit insurance.

Cryptocurrency transfers are irreversible and final. Network congestion delays confirmations; transfers sent to the wrong network or wrong address may be permanently lost. Deposits must be sent within their open deposit window: funds sent to an expired or closed window cannot be credited and may not be recoverable. Check the transaction and network before sending.

6. Cards

Cards are issued by our processing partners under Visa / Mastercard program rules, which also govern merchant disputes and chargebacks. You can reveal, freeze and unfreeze cards and set merchant blocks in your dashboard. Each card gets a US billing address for online purchases; you are responsible for keeping your card details and 3-D Secure codes secret. Cards may be closed by us or our partners as required by the card networks or law.

7. AML, sanctions and acceptable use

Do not use AtmosCard or its cards for unlawful activity, sanctions evasion, money laundering, fraud, or prohibited goods and services. We and our partners screen accounts and transactions against sanctions lists and applicable anti-money-laundering rules. We may demand identity verification, suspend or freeze accounts, decline transactions, or report activity to authorities where required or where we reasonably suspect violation of this section. Accounts used in violation can be suspended and balances returned less applicable fees, where law permits.

8. Promotions

From time to time we may run promotions. Their terms are shown when the promotion is offered and form part of these Terms. Promotions have no cash value and cannot be stacked. Duplicate accounts or other abuse voids any promotion and may result in suspension.

9. Suspension and termination

You may stop using AtmosCard at any time; closing your account closes your cards and settles any remaining balance subject to section 7 and applicable law. We may suspend or terminate access for breach of these Terms, legal requirements, or risk to the service. Where practical we give notice; where the law or a card network requires immediate action, we may act first.

10. Changes

Card programs, supported networks and fees can change as partners and chains change. Material changes to these Terms will be announced in the dashboard before they take effect, and — where we have your confirmed email — by email. The version and date at the top of this page always identify the terms in force.

11. Liability and disclaimers

The service is provided as-is. To the maximum extent permitted by law, AtmosCard's aggregate liability is limited to the balance held in your account at the time the claim arises. We are not liable for losses caused by a lost or stolen access code (where section 3 applies), blockchain network behavior, wrong-network or wrong-address transfers, third-party partner failures, or events beyond our reasonable control.

Nothing in these Terms limits liability that cannot be limited under California law, including liability for fraud, willful misconduct, or gross negligence.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Before filing a claim, contact us and give us 30 days to resolve the dispute informally. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction and venue.

If you are a consumer, nothing in this section deprives you of the protection of mandatory consumer rights under the law of your country or state of residence.
